The patron of Tiscali Renato Soru was sentenced to three years of imprisonment by the court of Cagliari tax evasion of 2.6 million euro as part of a loan made by the company Andalas Ldt (always Soru) to Tiscali. For two years he can no longer assume roles as managers. Immediate repercussions on the political level: Soru has resigned from the post of regional secretary of the Democratic Party of Sardinia. But it remains, at least for now, the Parliamentary Europe. The ruling was issued by the single judge Sandra Lepore. The prosecutor Andrea Massidda had called for a four-year sentence MEP, former regional president and secretary of the Democratic Party in Sardinia.

Soru: I did not expect, unjust sentence
“I did not expect this ruling, I expected to be acquitted, I think it is an unjust sentence. I do not think of having committed crimes, I think it is a judgment that I hope will be reversed in the other phases of the process, “Soru said a few minutes after the verdict. For the defense team is “a unique ruling that recognized the criminal responsibility for acts that the same financial offices had interpreted differently considering them non-existent.”

The story
Soru was on trial for tax evasion as a patron of Tiscali. A snap of the Guardia di Finanza investigations had been a service of transmission of Michele Santoro “Year Zero”, which aired in 2009 to address a series of financial transactions conducted by Italian operators abroad. Among the companies we mentioned there was also the Andalas Ltd, Soru company based in London, which would loan Tiscali about 27 million euro loan that would generate interest not declared and thus tax evasion. According to the indictment, the Andalas Ldt had a registered capital of two pounds, was not operational and would not pay taxes either in the UK or Italy. “I have always been honest and transparent – had said in court Soru discolpandosi – for this event have already paid a million and a half, but with Equitalia are now committed to pay nearly 11 million Euros.” Then directly addressing the judge had said: “I feel like I’m already paying, whatever it decides.”

The sentence
Your words are not served to avoid a sentence of three years. The judge said to him, “the disqualification from office of legal persons and companies, disqualification from representation and assistance in tax matters, and the inability to negotiate with the government.” All for a term of two years, while declared it unnecessary for four of the ten counts of crimes because they are prescribed. Just the prescription could be an important element in the appeal: if it were not fixed by April of next year, for certain offenses committed after January 2008 could not proceed.
